  Ex Post Facto Presentations

Although ex post facto cases are not specifically addressed in the Financial Rules and Regulations, they may be accepted by the Organisation under exceptional circumstances. This is done on the basis that all other UN procurement practices and procedures have been followed.

Ex post facto cases can be generated from administrative nature or driven by operational justification or exigency. Still, ex post facto cases should be rare exceptions. When they occur, written justification from the responsible Head of Department or Office shall be provided to explain the reasons why timely presentation was not possible.

There are two special types of cases that require presentation to Contracts Committees.

Clarification of Circumstances Leading to an Ex-Post Facto Case
Such justification must identify the causes for the ex post facto case and propose how to address the cause in order to avoid its recurrence in accordance with the provisions of the Controller's Inter-Office Memorandum dated 15 September 2005.
