  Notice of Consideration for Award

Where a vendor is likely to be awarded a Contract and there is a need to advise that vendor that it is being considered for such award before a Notice of Award can be issued to the vendor, the Procurement Officer/Assistant may issue a Notice of Consideration for Award to such vendor.

Such notice may be used if the expiration of the time limit for the acceptance of an offer is imminent or for other appropriate reasons. However, to the extent possible, the use of such notices shall be avoided, to protect the legal interests of the Organisation in the event a contractual instrument cannot be agreed upon. The notice may be transmitted by facsimile.

The text of a Notice of Consideration for Award should not be modified without consultation
with Office of Legal Affairs (HQ).

A Notice of Consideration for Award for cases in excess of the threshold value for submission to a Contracts Committee shall only be issued after due review and approval from the HCC/LCC.

The issuance of a Notice of Consideration for Award does not constitute a Contract. The Procurement Officer/Assistant should make this clear to the vendor and inform them that any actions taken in expectation of the signature of a Contract or the receipt of a Purchase Order are at their own risk and that the issuance of the notice does not create any obligations on the part of the UN.
